ITHAKA, a not-for-profit organization that helps the academic community advance research, offers text analysis support to its users for the non-consumptive research of academic content provided by ITHAKA’s JSTOR service, for use by the research community in support of ITHAKA’s mission. By using JSTOR’s text analysis support, you agree to the JSTOR Terms and Conditions of Use and the following Terms.

1. Definitions
- “Basic Research Data” is defined as the data which ITHAKA makes generally available for direct download by an individual user, including bibliographic metadata for JSTOR Collection Content and JSTOR Open Collection Content as those terms are defined in the JSTOR Terms and Conditions of Use. Please note that ITHAKA and its Content Contributors shall decide in their sole discretion what data to include with Basic Research Data.
- “Advanced Research Data” is additional data beyond Basic Research Data, including select full-text JSTOR Collection Content and JSTOR Open Collection Content, that ITHAKA may, in its sole discretion, choose to share with a Researcher (defined below) in connection with a Requested Project agreed to by ITHAKA. ITHAKA may also, in its sole discretion, assess a fee for delivering such Advanced Research Data taking into account the size and scope of the request.
- “Requested Project” is a specific non-commercial scholarly research project requiring the export and use of Advanced Research Data within the computing environment used or controlled by the Researcher. Researchers may submit a request to ITHAKA to conduct a Requested Project, providing full details of the scope of the project and Advanced Research Data required. ITHAKA in its sole discretion will decide whether to engage in the Requested Project or any portion thereof. ITHAKA may also in its sole discretion require agreement to contractual terms in addition to these Terms.
- “Researcher” is defined as an individual user who may download, export, or otherwise receive access to Basic and/or Advanced Research Data from ITHAKA to engage in non-commercial scholarly, academic, or educational research.
- “Text and Data Analysis” is defined as a machine process by which information may be derived from content by identifying patterns and trends within natural language and/or numeric data through methods such as text categorization, statistical pattern recognition, concept or sentiment extraction, and the association of natural language with indexing terms.

2. Permitted Use
In connection with JSTOR’s provision of Basic or Advanced Research Data, Researchers may:
- search, view, reproduce, display, distribute, download, and use Basic Research Data for the purpose of identifying relevant items of Advanced Research Data to request in connection with a Requested Project.
- perform Text and Data Analysis for academic research, scholarship, and other educational purposes, utilize and share the results of analysis in the Researcher’s scholarly work, and make the results available for use by others;
- make local digital copies of a reasonable portion of the Basic or Advanced Research Data used in the research (“Retained Data”) to the extent necessary to ensure efficient use of such content in connection with relevant work;
- create one (1) copy of the Retained Data to be maintained as a backup copy. Researchers may continue to store and use the backup copy in accordance with these Terms as long as is needed for conducting research;
- extract and use excerpts from the Advanced Research Data for academic research, scholarship, and other educational purposes, including extraction and manipulation for the purpose of illustration, explanation, example, comment, criticism, teaching, research, and analysis. Reasonably small but representative samples of the data contained within the Advanced Research Data may be included in scholarly research and educational materials and may be displayed/presented. Researchers should provide appropriate attribution or citation to the source material where possible;
- transmit to other Researchers at other institutions, in paper or electronically, reasonable amounts of the Retained Data for personal, scholarly, educational, scientific, or research uses, but in no case for resale. Scholarly sharing shall in no case be a replacement for a subscription/purchase of either the original publications or JSTOR;
- selectively extract datasets from the Advanced Research Data; translate, adapt, alter, transform, modify or arrange data; and electronically converge and merge additional datasets in the most appropriate form for the research being conducted. The Advanced Research Data portion of the combined dataset must still be used in accordance with these Terms.
For the purpose of clarity, JSTOR Open Collection Content may be used more broadly as indicated in JSTOR’s Terms and Conditions of Use.

3. Prohibited Use
Researchers may not:
- create a product or service that would substitute for the licensing and/or use of the original publications, JSTOR, or any text and data analysis service built by JSTOR, Portico, their publisher participants, or the Content Contributors;
- use the Basic or Advanced Research Data for any commercial purpose;
- hold more than the maximum number of items of Advanced Research Data permitted by JSTOR at any one time. Such number will be determined at ITHAKA’s sole discretion and may be adjusted at any time; or
- use the Basic or Advanced Research Data to build, train, fine-tune, or otherwise enhance the output of any LLM or other artificial intelligence model, system, platform, or software.

4. Additional Responsibility for Advanced Research Data
If ITHAKA agrees to provide Advanced Research Data in connection with a
Requested Project, Researchers will:- treat and hold the Advanced Research Data as confidential and use reasonable measures to keep it secure;
- use the Advanced Research only in connection with the Requested Project;
- keep the Advanced Research Data for only as long as is appropriate to the Requested Project and will alert JSTOR when the data is deleted;
- be responsible for ensuring that any articles or reports about the Requested Project developed for publication do not improperly disclose the Advanced Research Data (namely, disclose more than discrete portions of the data for the purpose of comment); and
- if they are collaborating with others on a Requested Project, ensure each additional Researcher is aware of and agrees to these Terms.

5. Technical Requirements
ITHAKA will provide documentation regarding the technical specifications of its text analysis support offerings and update this documentation as needed.

6. Acknowledgement of ITHAKA
When publishing work using ITHAKA’s data, Researchers:
- agree to acknowledge ITHAKA and the JSTOR content in any reports or articles published at the conclusion of the research, if reasonably practicable;
- agree to allow ITHAKA to mention the report or article in our publications or marketing materials as an example of how our services are utilized, unless they choose to opt out by emailing support@ithaka.org; and
- are invited to share with ITHAKA a copy of any reports or articles published at the conclusion of the Project so that ITHAKA may learn more about how its data is used.

7. Termination
ITHAKA may suspend or terminate a Researcher’s license to hold and use its data upon notice if it has reason to believe there has been a violation of these Terms. Upon termination of this agreement and/or the Requested Project, Researchers will immediately destroy any Advanced Research Data they may have in their possession and inform anyone with whom they shared the Advanced Research Data to do the same.
